Cubox Terms of Use

Cubox (cubox.cc) is operated by Zenbox Inc. Zenbox Inc. provides services to users through Cubox in accordance with the provisions of this agreement, and this agreement has the legal effect of a contract between the user and Zenbox Inc.. Zenbox Inc. hereby reminds users to carefully read and fully understand the terms of this agreement, especially the terms of exemption, limitation of Zenbox Inc.'s liability, restrictions on user rights, dispute resolution, and applicable laws. Please read carefully and choose whether to accept this agreement. Unless the user accepts all the terms of this agreement, the user has no right to use the services provided by Zenbox Inc. under this agreement. After the user registers, logs in, or uses Cubox, this agreement constitutes a legal document binding on both parties.

User Registration

In order to protect the rights and interests of users, users must carefully read all the terms of this service agreement before voluntarily registering to use Cubox services. The user has to agree to and accept all the terms of this agreement and complete the registration process in order to become an official user of Cubox. The content of this agreement includes the text of the agreement and all the various service terms and rules that Zenbox Inc. has published or may publish in the future. All terms and rules are an integral part of the agreement and have the same legal effect as the agreement. When applying for the use of Cubox services, users must provide real personal information in good faith, and should update the registration information in time to ensure the authenticity and accuracy of the user's personal information. If there are problems and consequences caused by untrue registration information, the user shall bear the corresponding responsibilities and consequences, and Cubox reserves the right to terminate the user's use of Zenbox Inc.'s services. All information provided by users during registration is voluntary.

User Account

After the user has successfully registered in Cubox, Zenbox Inc. will open an account for the user as the user's unique identification when using the service in Cubox. The user name and password of the account are set by the user and the user is responsible for safekeeping. All operations through the user name are by default recognized as user's own behavior, and the user shall bear all legal responsibilities. When using Cubox services, users should save and use user names and passwords cautiously, reasonably and safely. If users find any illegal use of user accounts or security loopholes, they should immediately notify Zenbox Inc. and report the case to the public security department. Cubox does not assume any responsibility for the illegal use of the account and password by others due to the negligence of the user or the user's negligence in custody.

User Information Collection and Use

When using the Cubox service, users need to disclose some necessary information as required, including but not limited to nickname, email address, etc. The user shall ensure that the information is true, accurate, valid, and complete when provided, and shall promptly update the information according to the actual situation or the requirements of Zenbox Inc.. The user shall be solely responsible for the restriction or loss of the user's enjoyment of Cubox services due to incomplete or untrue information disclosure or untimely information update. In addition to the necessary information, users also have the right to disclose some other information at their own discretion. Cubox will take appropriate measures to provide sufficient information security protection for user information in accordance with the requirements of relevant laws. Users should properly keep and use their user information, such as account numbers and passwords. Any loss to the user caused by the above information leakage, including any loss caused by information leakage caused by the use of any third-party application software of Cubox, shall be independently borne by the user. If the user leaks any of the above information or finds that any of the above information has been or may be leaked, the user should also immediately notify Zenbox Inc. in a timely and effective manner, so that Zenbox Inc. can take measures within a reasonable time to prevent the loss from continuing to expand, while Zenbox Inc. will not bear the consequences of any outcome, nor bear any responsibility for the consequences that have occurred before. Zenbox Inc. guarantees that it will not disclose or provide users' personal information to any unrelated third parties, except in one of the following situations:

• Obtain the user's permission before disclosing or providing relevant information;
• Disclose or make available as required by law or policy;
• Disclose or provide user's personal information only when the goods or services required by the user be provided;
• Disclose or provide at the request of state authorities;
• Disclose or provide in accordance with other terms of this agreement.

The user understands and agrees that Zenbox Inc. may sell or transfer to a third party in the event of reorganization, dissolution, bankruptcy liquidation, merger, and acquisition, etc. of Zenbox Inc.. In such transactions, as an integral part of Cubox, your user information may also be transferred to the third party so that the third party can continue to provide you with services. Change of Rules

Zenbox Inc. may change the rules of this service as needed. Modifications and changes to service rules will be included in Cubox's updated rules. All changes are severable, and if some of the changes or terms are found to be invalid, it will not affect the validity of other changes or terms. When using the various services provided by Zenbox Inc., the user undertakes to accept and abide by the provisions of the relevant terms.

Intellectual Property Terms

Zenbox Inc. is the producer of this site and the developer of related applications. It has legal rights such as copyright of related service content and resources and is protected by national laws. The copyright of the information content produced, published, and disseminated by Cubox, as well as the product design, product assets, and other copyrights are owned by Cubox. Without the express written permission of Zenbox Inc., no unit or individual may illegally copy, reprint or quote, link, scrape in whole or in part in any way, or use the information content of Cubox-related services, or use it for any commercial purpose. Otherwise, Zenbox Inc. has the right to pursue its legal responsibility. The materials displayed by Cubox (such as text, graphics, logos, button icons, images, sound file fragments, digital downloads, data compilations and software) are the property of Zenbox Inc. or its content providers and are protected by Chinese and international copyright laws. The compilation of all content on this site is the exclusive property of Zenbox Inc. and is protected by Chinese and international copyright laws. All software on this site is the property of Zenbox Inc. or its affiliates or its software suppliers, are protected by Chinese and international copyright laws.

Limitation of Liabilities

Unless clearly required by laws and regulations, Cubox is not obliged to review all the information data, pictures, videos and other information content collected by users in Cubox in advance, and Cubox is not obliged to assume any responsibility for the above-mentioned information collected by users in Cubox. The user agrees that Cubox shall not be liable for any damage to the user caused by any of the following circumstances, including but not limited to damages for loss of profits, goodwill, use, data, etc., or other intangible losses (whether or not Zenbox Inc. has been informed of the possibility of such damages):

• Unauthorized use of the user's account or alteration of your data by third parties;
• User's misconduct of Cubox service due to misunderstanding;
• Any other damages not caused by Zenbox Inc..

Under no circumstances shall Zenbox Inc. be liable for any damages of failure to service or delay in service due to normal equipment maintenance of the information network, failure of the information network connection, failure of computers, communications, or other systems, power failure, strikes, labor disputes, riots, uprisings, productivity or production insufficiency, fires, floods, storms, explosions, wars, government actions, orders of judicial or administrative agencies, or inaction of third parties. The Cubox service provides a complete cloud data backup function for the user's personal database, but Zenbox Inc. is not responsible for the failure of the Cubox system or the loss of user information due to force majeure or other reasons beyond the control of Zenbox Inc.. Zenbox Inc. will assist in the aftermath as reasonably as possible and strive to protect users from financial loss.

Termination of Service

If the user proposes to Zenbox Inc. to cancel the user account, the user will cancel the service agreement relationship with Zenbox Inc. if the account is canceled after Zenbox Inc.'s review and approval. However, after canceling the user account, Zenbox Inc. still reserves the following rights: If the user has violated the law on Cubox or violated this agreement before the cancellation, Zenbox Inc. can still exercise the rights stipulated in this agreement. In the following cases, Zenbox Inc. can terminate the service by logging out the user:

• If the user violates the relevant provisions of this agreement, Zenbox Inc. has the right to terminate the provision of services to the user;
• Zenbox Inc. finds that the main content of the user's registration information is false, and Zenbox Inc. has the right to terminate the provision of services to the user at any time;
• When this agreement is terminated or updated, the user is unwilling to accept the new service agreement.

User Guidelines

Any form of information content collected by users in Cubox shall not include the following:

• Oppose the basic principles established by the Constitution, incite, resist or undermine the implementation of the Constitution and laws and administrative regulations;
• Incitement to subvert state power, overthrow, incite, split the country, and undermine national unity;
• Incitement of ethnic hatred, ethnic discrimination, or undermining ethnic unity;
• Anything that discriminates against race, gender, religion, geographical content, etc.;
• Promoting feudal superstition, cult, obscenity, pornography, gambling, violence, murder, terror, and abetting crime;
• Transmit any illegal, harassing, slandering, abusive, threatening, hurtful, vulgar, obscene, uncivilized information materials;
• Other violations of the Constitution and laws and regulations.

The user agrees to strictly abide by the following obligations:

• Not to use Cubox to engage in illegal and criminal activities such as money laundering, stealing trade secrets, stealing personal information;
• Not to interfere with the normal operation of Cubox, not to invade the website and computer information system;
• Not to use the account or member account registered with Cubox for profit-making business activities.

If the user fails to comply with the above provisions, Zenbox Inc. has the right to make an independent judgment and take measures such as suspending or canceling the user account, and deleting the text that does not meet the requirements without notifying the user. Users are solely responsible for their own words and actions online. If the user violates the above provisions and causes losses to Zenbox Inc. or any other third party, the user agrees to bear all the liability for damages caused thereby.

Law Applications and Disputes

If there is any dispute between the user and Zenbox Inc. regarding the content of this agreement or its performance, both parties shall strive to resolve it through friendly negotiation; if the negotiation cannot be resolved, either party shall submit the dispute to the people's court with jurisdiction where the defendant is located.
